Distance Selling Contract

1 - PARTIES 
SELLER: 

2 – FUNDAMENTAL QUALIFICATIONS OF THE CONTRACTUAL GOODS AND SERVICES 
The kind, type, brand/model, color, number/quantity, sales price including all taxes and payment type of the Good/Product/Service are as specified in the introductory pre-information. Detailed information pertaining to the qualifications of the following good or service can be reached through search in our internet shopping website https://www.kidodidoshop.com as per the relevant good or service code. 

3 – SALES PRICE 
Total sales price: 
(Buyers are responsible for any customs and import taxes that may apply.)

4 – VALIDITY TERM OF THE SALES PROMISES 
The validity term of all our promises including price is valid as of the time (day, hour, minute) of the establishment of the order. 

5 – PAYMENT TYPE OF THE PURCHASED GOOD AND SERVICE

6 – DELIVERY TYPE AND FEES 
Delivery Type:

(Since the Delivery/Cargo fee is incorporated into the total order amount, it is paid by the SELLER. Also in the purchases that are made through payment at the door, the cargo/delivery fee is incorporated into the total price.) 

The contractual good or service is delivered to the BUYER or the person/institution at the address designated by the BUYER within the term explicated in the pre-information based upon the distance of the residential area of the BUYER for each and every good, provided that the legal term of 30 days is not exceeded. The referred term may be extended for at most 14 days more provided that the BUYER is previously notified accordingly. 

7 – RIGHT OF WITHDRAWAL 
7.1 EXERCISE OF RIGHT OF WITHDRAWAL 
The BUYER has the right of withdrawal within 14 (fourteen) days as of the delivery of the subject matter good to itself or the person/entity at the address designated by the same. For the exercise of the right of withdrawal, a notification should be made to the SELLER via fax, e-mail or telephone within such term and the good should not have been used. In case of the exercise of such right, the copy of the cargo delivery report substantiating that the good delivered to the third party or BUYER has been sent to the SELLER and the original invoice should be returned. The price of the good is returned to the BUYER within 10 (ten) days as of the receipt of such documents and subject matter good by the SELLER. If the original invoice is not sent, VAT and other taxes and other legal obligations, if any, shall not be returned. The cost for the product’s delivery to our warehouse will be entirely at the customer’s expense while the delivery of the new product will be at the expenses of Kidodidoshop. 

7.2 EVENTS WHERE THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED 
Right of withdrawal cannot be exercised for the goods that cannot be returned on account of their nature, single-use goods, duplicable software and programs, hastily corrupting or expired goods. The exercise of right of withdrawal for the following goods or services is contingent upon the fact that the package of the same - in case of good – has not been opened, deteriorated and the same has not been used. 
All and any kind of software and programs 
Medias such as DVD, VCD, CD, cassette and similar 
Computer and stationery consumables (consumables such as Toner, cartridge, band which cannot be reused when opened) 
All and any kind of cosmetics 
Food, beverage and goods oriented to the daily use of public 
Bank, insurance agreements 
Agreements concluded with vending machines 
Orders for airtime minutes 
Agreements concluded through open bidding 
Agreements comprising of provisions on the supply by the provider of accommodation, transportation, food supply, sportive and cultural activities and entertaining services on a special day or at a special time as assumed by the provider. 

The agreements on the services performed simultaneously in the electronic media and goods instantly delivered to the consumer are not subject to the provisions on the right of withdrawal and the exercise thereof. 

Furthermore, the consumer cannot exercise its right of withdrawal for the products that are produced under the special requests and demands of the consumer or that are rendered to be special to the person upon alterations or supplementations thereon. 

8 – COMMUNICATION OF DEMANDS OR COMPLAINTS 
The BUYER may communicate its requests and complaints by the use of the contact information of the SELLER as specified in article 1. 
The BUYER may make its applications for complaints and objections to the arbitration committee for consumer problems or consumer court at the place the BUYER purchased the good or service or has its domicile within the monetary limits as ascertained by the Ministry each year in December. 

The BUYER accepts and declares that it has gained information by reading this “Pre-Information” and it has given the required approval in internet or electronic media.
